Notas de una agenda de investigación. Justicia vecinal y formalización de derechos a la tierra (Chile, siglo XIX)

El examen de la justicia vecinal y la formalización de los derechos a la tierra en Chile central durante el siglo XIX revela la coexistencia y negociación constante entre, por un lado, una cultura propietaria caracterizada por el dominio desdoblado y por el valor de la posesión y, por otro, los procesos emergentes de titulación individual y la propiedad plena. Estas páginas sintetizan una agenda de investigación volcada al análisis de pleitos judiciales por tierra y escrituras notariales, evidenciando que la justicia vecinal, administrada por jueces legos y habitantes del territorio, no solo tendía a dirimir los conflictos, sino que también legitimaba y adaptaba derechos desdoblados y de posesión en un contexto de transformación institucional y de las ideas jurídicas. Este fenómeno condujo a formas híbridas de dominio, donde la posesión y los derechos desdoblados tradicionales se integraron en los títulos inscritos, demostrando que la formalización no significó la desaparición de las prácticas locales, sino su reconfiguración y persistencia en los nuevos formatos institucionales. La agenda de investigación ha contribuido a superar el formalismo legal que sustenta la discusión bibliográfica al respecto, resaltando, en cambio, la justicia vecinal como espacio dinámico para la gestión social de los derechos a la tierra, particularmente en el caso de pequeños y medianos agricultores, poseedores consuetudinarios de derechos.Palabras clave:
