Incapacidad de herencia y legado del último confesor: de la Novísima Recopilación al artículo 965 del Código Civil de la República de Chile

Abstract

The author treats on the influence of the Canon law in the civil law, due to the factual survival of the Patronage, referred to the situation in which the canonical norm becomes an instrument of intelligibility of the respective article of the Civil Code. The cases in which this happens in the Civil Code of Chile are not scarce, and an example of it is the incapacity of inheritance and bequest of the last confessor, in which a direct bridge among the Novísima Recopilación (1805) and the Civil Code (1855) is clearly detected.
