De William Blackstone a Roscoe Pound: genealogía de una epistemología jurídica angloamericana

Resumo
La exégesis, generación tras generación, del pensamiento de Roscoe Pound lo ha convertido en un clásico del realismo jurídico americano. No han faltado biografías intelectuales tratando de reconstruir su génesis, explicar influencias y documentar antecedentes. Sin embargo, estos intentos raramente sitúan las ideas de este padre putativo del realismo fuera de la línea demarcada por el tropo historiográfico de la antítesis entre formalismo y antiformalismo. Una distinción que asume siempre la ontología del derecho antes de afrontar su ciencia. En este artículo, se adoptará una nueva mirada desde el derecho como epistemología para elaborar la genealogía de los presupuestos de Pound. Dicho cambio nos llevará a revisitar los caminos paralelos de la tradición de Common Law, con figuras como William Blackstone y Henry S. Maine, por un lado, y Jeremy Bentham y John Austin por otro; caminos que se cruzan en Oliver Wendell Holmes, Jr. antes de desembocar en nuestro autor. A través de este ejercicio, podremos ver cómo, en dicha tradición, el estatuto epistemológico de las normas ha oscilado entre verdad formal y material.Palavras-chave:
